Terms of service

These terms apply to services provided by Ascot Digital (ABN 46 747 589 785). Each client also signs a written agreement setting out their scope, price and timeline. If anything here differs from your agreement, your agreement applies. Nothing in these terms limits your rights under the Australian Consumer Law.
Services and pricing
Our services are quoted for each business after a free audit. Pricing is a one-off setup fee plus a monthly fee. Prices are quoted in Australian dollars, plus GST.
Minimum term
Monthly services have a 12-month minimum term from the date you sign. After that, they continue month to month until either of us gives 30 days’ written notice.
Payments
The setup fee is due before work starts. Monthly fees are billed automatically in advance by card or direct debit through our payment provider, Stripe. If a payment fails, we will let you know and the payment is retried. If it is still unpaid 7 days after the due date, we may pause services until it is paid.
Cancellations and refunds
If you cancel before any work has started, we refund the setup fee in full. Once work has started, the setup fee is not refundable. Monthly fees are not refunded for part months.
If you end the service before the 12-month minimum term is complete, the monthly fees for the rest of the minimum term are payable. We may waive this at our discretion.
Advertising spend
Where we manage Google Ads for you, you pay Google directly for your ad spend. Our fee covers managing the campaigns.
Who owns what
Once the setup fee is paid, you own your website’s design, content and files, and your domain name is registered in your business’s name. We may host your website on our accounts as part of the monthly service.
Our tools, templates, automations, AI receptionist setup and reporting systems remain ours. These are provided as a service while you are a client.
When the service ends and all fees are paid, we hand over your website files and help move your domain and hosting to you, at no extra charge. Services that run on our tools then stop.
Results
We work to bring you more enquiries, but we do not guarantee rankings, leads, calls or sales. Search engines, advertising platforms and AI services are outside our control and can change without notice.
AI receptionist and calls
Where we set up an AI receptionist, it tells callers they are speaking with an AI assistant and that calls may be recorded. You approve its script before it goes live, and you are responsible for any rules specific to your industry. AI replies can occasionally be wrong, so important details such as prices, bookings and commitments should be confirmed by your business.
Your responsibilities
You confirm you have the right to any content, photos and information you give us to use, and that the claims we publish for you are accurate.
Showing our work
We may show your website and business name in our portfolio and case studies. You can ask us not to at any time in writing. We only publish your results or figures with your permission.
Liability
To the extent the law allows, our total liability to you is limited to the fees you paid us in the 3 months before the claim, and we are not liable for indirect losses such as lost profits. This does not limit any rights you have under the Australian Consumer Law that cannot be excluded.
Governing law
These terms are governed by the laws of Victoria, Australia.
